Recent ruling by Armed Services Board of Contract Appeals

This is from a recent ruling (ASBCA No. 57834, page 7) GaN Corporation. It does not get much clearer than this.

The government appears to think that the various references to actual payment andcost mean that the contractor cannot recover for hours unless the employees were paid on an hourly basis.  We disagree.
